Terms and Conditions

Please read these Terms & Conditions carefully. Your booking and payment for a holiday constitutes acceptance of them.

CONTRACT

The contract for a short-term holiday rental shall be made between the client and Champernhayes, subject to the following booking conditions: -

PAYMENT

A deposit of one third of the rental is payable on booking. Provisional bookings are held for 4 working days only. The balance of the rental is payable 42 days prior to arrival. For bookings made less than 6 weeks in advance, the total amount is payable on the booking. Cheques should be made payable to‘Champernhayes Holiday Lettings LTD’and sent Bookings, Champernhayes Holiday Lettings Ltd, Joyfields, Chestnut Avenue, Westerham, TN16 2EJ. Any payment received automatically acknowledges and accepts the booking conditions.

CANCELLATION

Any cancellation made by the client for whatever reason shall be in writing and addressed to

Cancellations, Champernhayes Holiday Lettings Ltd, Joyfields, Chestnut Avenue, Westerham, TN16 2EJ.

On receipt of notice of cancellation, Champernhayes will seek to re-let the property for the whole period of the booking. If Champernhayes succeeds in re-letting the property for the whole period it shall refund all the monies paid less an administrative charge of £20.00 per booking. If Champernhayes only succeeds in re-letting the property for part of the period booked it shall refund an amount equal to the monies paid less (1) the rental for the period that is not re-let and (2) an administrative charge of £20.00 per booking. If Champernhayes is unable to re-let the property before the final payment is due, the client still remains liable for the final payment on the due date as indicated in the Payment section. If Champernhayes is successful in re-letting the property for the whole or part of the period of the booking after the client has made the final payment, the client will be reimbursed in accordance with the refund conditions above.

The client is advised to take out a separate holiday cancellation insurance. (Details will be sent with your booking confirmation.)

PERIOD OF HIRE

Rentals commence at 3.00 pm on the day of arrival and terminate at 10.00 am on the day of departure.

Please advise if arrival time is expected to be after 6.00 p.m. for key collection arrangements.

VAT

VAT at the current rate of  20% is included in the rental fee. If VAT rates change, Champernhayes reserves the right to amend prices accordingly.

NUMBER OF GUESTS PER COTTAGE

The number of persons occupying a property must not exceed the maximum number stipulated in the brochure or website. Children over the age of 2, not sleeping in a travel cot, count towards the total number of guests. Up to 2 extra beds can be provided for The Barn and The Farmhouse at an additional cost. Extra beds are not available for any of the other cottages, and rollout beds are not permitted.

The names, and ages of guests under 18, staying at Champernhayes, and any intended visitors, must be advised in writing, in case of emergency.

COMPLAINTS

Your stay at Champernhayes should be an enjoyable break. Nevertheless, should you have cause for complaint, please advise Champernhayes immediately, as it is difficult to investigate complaints of any nature once a client has returned home. Regrettably, therefore, it is unlikely that complaints can be accepted and investigated at the end of the hiring period or after the client has departed.If in the opinion of the Hirer there are grounds for complaint, it is the duty of the Hirer to take it up with the Owner immediately or soon as reasonably possible and in any eventbefore departureto allow remedial action to be taken. It is specifically agreed that failure by the Hirer to notify the Owner of any complaint in accordance with the timescale above will entitle the owner to refuse to entertain the complaint, irrespective of its merit. 

Please note that in the  event of a problem you should contact the owner/Housekeeper  immediately to allow remedial action to be taken. However, please note any complaints raised on arrival, during after your holiday  without opportunity for the owner to offer a solution or if required offer an alternative property (subject to availability ) will not result in any form of compensation  or full refund. We encourage guests to investigate and purchase insurance from a reputable third party.

SMOKING POLICY

Clients are reminded that all the cottages at Champernhayes are non-smoking.

Smoking is not permitted in any of the cottages, or in the pool building.

CARE OF PROPERTY

The client shall take all reasonable and proper care of the property and its contents, furniture, pictures, fittings and effects in or on the property and leave them in the same state of repair and condition and in the same truly clean and tidy condition at the end of the hire period as at the beginning. Although the client might not be charged for minor breakages (e.g. glasses), the client is responsible for all damage or breakages. Champernhayes reserves the right to charge for any breakages or for any additional cleaning that may be required in the cottages are not left in a clean state. This will be charge at  a rate of £14/hour and the guest will be notified and invoiced with reasons  within 48  hours of departure when our cleaning staff have reviewed conditions etc .

Whilst you are staying in the property it is you and your parties’ responsibility, to keep the property clean and tidy and to leave it in this condition at the end of your holiday. We appreciate the need for you to have an enjoyable time whilst on your holiday; however, we would also ask you to respect the holiday cottage and its neighbours and not disturb or cause offence in any way. You must allow us, or the owner, or their employees access to the property during reasonable hours, except where an emergency problem needs to be remedied immediately and you are out of contact, in which case, they may enter the property without your prior agreement. Pets may not be taken to the property unless they have been booked-in with us and confirmed in writing to you. The property cannot be used for any commercial purposes, nor sublet or assigned to anyone not accepted by us as a party member.

Linen and towels, but not towels for external use, are provided in all properties. Cot linen is  not be provided at all properties, and you should confirm this with the Agent prior to booking if this is a requirement. Linen is changed between tenancies and weekly during tenancies (unless otherwise agreed). 

Music

Loud music is not permitted between 11pm and 9am within the grounds of the rental property (unless otherwise stated).

Personal Safety

Please note that some properties have ponds or tree houses and it is the responsibility of the holidaymaker to keep all guests in their party safe at all times, in all properties. We also have cottages on working farms where there are hay and silage bales, these are out of bounds.

GUEST SAFETY

The Owners take the safety of guests very seriously. Therefore we ask that guests who stay in the Property take a few moments to think about their safety at the Property. In particular You should:

1)  Check the layout of the Property, so that in an emergency You and your party can get out quickly and easily.

2)  Check the locations of the fire extinguishers and fire blanket and read the instructions for use.

3)  Check the location of the first aid box.

4)  Read and take note of specific safety information provided in the Property, concerning the use of electrical items adn the pool area.

If you have any concerns about the safety of the Property, whether it be the garden, equipment or facilities, You should contact the owner or representatives immediately on any of the contact numbers provided 

Special Occasions

Champernhayes is very popular for celebrations and family events. Please note that No party, event or gathering may take place at the property which exceeds the maximum agreed occupancy numbers for the property without prior consent. It is also not permitted for any commercial enterprise or supplier of leisure activities to visit the property during your stay without the owner’s consent e.g. a caterer, magician etc. Failure to adhere to this clause may result in additional charges. It is also not permitted for any alcohol to be sold on the premises without permission. Should any of these terms be breached the owner has the right to repossess the property without any compensation or refund due to you or your party.

CHAMPERNHAYES DUTY OF CARE

All properties are maintained to a high standard. In the event of a breakdown, a repair/replacement shall be found/fitted within 48 hours where possible. Champernhayes cannot be held liable for a breakdown of any facility which is beyond reasonable control (e.g. breakdown or failure of any electrical equipment, facility or plumbing) or from any misuse or negligence of the client using Champernhayes’ equipment or facilities resulting in loss, injury or accident.

Off-road parking is provided adjacent to each cottage. Parking is entirely at the client’s own risk and no liability is accepted for any loss, damage or injury howsoever caused.

Champernhayes is situated in a farming environment, and no responsibility is accepted for any damage or inconvenience caused by farm stock and/or wildlife.

PROHIBITED

The use of FIREWORKS are prohibited on the grounds of Champernhayes Holiday Cottages due to thatch roofs and farm animals.

Smoking is not permitted in any of the cottages.

PETS

Pets are accepted by prior arrangement provided that they have their own sleeping bed/basket and are not left unattended in the property. They must be house trained, well behaved, kept off the soft furnishings/beds and exercised away from the cottages. All dogs must be kept on a leash when on-site.

PERSONAL INJURY & LOSS OF CLIENT PROPERTY

The client or members of his/her party cannot hold Champernhayes responsible for injury sustained or the loss or damage to any belongings during their stay at Champernhayes. The proprietor accepts no liability for accident, injury, loss or damage sustained by any residents, their family, visitors, animals, vehicles or personal effects however caused.

RIGHT OF ENTRY

Champernhayes reserve the right to enter any cottage at any reasonable time for purposes of inspection or to carry out necessary repairs or maintenance.

CHAMPERNHAYES RIGHT TO REFUSE

Champernhayes reserves the right to refuse any booking and in exceptional circumstances, to cancel, modify or alter arrangements made for the client. Champernhayes reserves the right not to accept a booking or refuse entry if any of the booking conditions are not met, and to order any unauthorised person off the premises. Champernhayes reserves the right to refuse all single sex parties. No stag or hen parties accepted.

CIRCUMSTANCES BEYOND CHAMPERNHAYES’ CONTROL

If for any reason a cottage is not available or has been rendered unsuitable for holiday letting (e.g. water damage/fire damage) on the date booked, Champernhayes will offer alternate accommodation or alternate dates, or offer a refund of all monies paid by the client. There shall be no further claim against Champernhayes.

DATA PRIVACY STATEMENT

We treat any data collected during the course of making bookings or dealing with enquiries in strict confidence. Your data will never be sold. As members of Premier Cottages (a marketing collective of the best four and five star cottages in the UK) we have agreed to supply to Premier Cottages Ltd the names, postal and email addresses of all guests booking with us or proposing to book with us during the previous year, in order that these guests/potential guests may be sent a Premier Cottages brochure and sent promotional emails from time to time. By accepting these terms and conditions you are indicating your consent to receiving these communications from us unless you let us know otherwise, which you can do at the point of booking by ticking the Marketing Notes box in the extras section. If at any time you would like your details removed from this list all you need do is to click the unsubscribe link on any of the emails or contact us via email: info@champernhayes.com and we will arrange for you to be removed from the mailing list

Limitation of liability

While we will use reasonable endeavours to verify the accuracy of any information we place on the website, we make no warranties, whether express or implied in relation to its accuracy. The website is provided on an “as is” and “as available” basis without any representation or endorsement made and we make no warranties of any kind, whether express or implied, in relation to the website, or any transaction that may be conducted on or through the website including but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade. We make no warranty that the website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website. To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the products. This does not affect your statutory rights as a consumer, nor does it affect your contract cancellation rights. We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the conditions for:

ADDITIONAL TERMS & CONDITIONS

In addition to the terms and conditions stated here, there may be specific terms and conditions which apply to the facilities at Champernhayes such as those concerning the use of the swimming pool. These will be prominently displayed at Champernhayes and /or in the cottage information folders, and constitute part of these general Terms & Conditions.
